This man was booked into the ADA County Jail on charges of vehicular manslaughter after falling asleep at the wheel. Do you think he should be behind bars?

It's every drowsy drivers worst nightmare, falling asleep at the wheel. Most of us think it's something that won't happen to us; we can stay awake no matter how sleepy we are, but recently I personally witnessed how easily it can happen.

I was driving back from Utah with my husband and two children a few weeks ago when all of a sudden my husband swerved sharply to the left. I couldn't comprehend it for a second, what was he doing? Then I realized he had fallen asleep and we were about 2 seconds away from hitting a barrier on the freeway. I yelled at him "Are you Asleep?!" and he quickly woke up and seemed very startled by the experience.

Boone Hallmark is a 31 year old Boise man who had a tragic experience with falling asleep at the wheel.

July 2, 2014 Boone was driving on U.S. Highway 12 near Kooskia when he fell asleep at the wheel. His PT Cruiser plunged into the Lochsa River and although he survived the crash killed his passengers, 2 year old Layton Hallmark and 22 year old Talia Rushing.

Police caught up to Hallmark this past Sunday night when they responded to a suspicious car report and discovered Boone had a warrant out for his arrest.

He was released from jail less than 24 hours later on a $2,000 bond and his next court date has not been set.

I see this as a tragic accident. His actions were not malicious, but it raises the question, should someone who falls asleep at the wheel be charged with manslaughter if a deadly accident occurs?
